These Terms of Service (“Terms”) govern your use of the BDD Dustoff platform and services provided by BDD Dustoff LLC (“BDD Dustoff,” “we,” “us,” or “our”). Your use of specific platform features is also governed by the Software Access Agreement you accept at signup. Where the Software Access Agreement and these Terms address the same subject, the Software Access Agreement controls.
1. Acceptance of Terms
By creating an account or using the platform, you agree to these Terms and to the Software Access Agreement presented at signup. If you do not agree, do not use the service.
2. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account.
3. Prohibited Uses
You agree not to:
- use the service for any unlawful purpose or in violation of any applicable law;
- upload records you do not have the right to share;
- attempt to gain unauthorized access to the platform, other accounts, or our systems;
- interfere with or disrupt the integrity or performance of the service; or
- misrepresent your identity or your affiliation with any person or entity.
4. Intellectual Property
The platform, including its software, design, and content (excluding records and information you provide), is owned by BDD Dustoff LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the platform for its intended purpose. You retain ownership of the records and information you upload.
5. Disclaimers
BDD Dustoff is a software platform that helps you organize and review your records. We are not a law firm, are not a VA-accredited representative, and do not provide legal, medical, or claims representation advice. We do not guarantee any particular claim outcome or VA disability rating. The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
6. Limitation of Liability
To the fullest extent permitted by law, and as further described in the Software Access Agreement, BDD Dustoff LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. The limitations and remedies set forth in the signed Software Access Agreement apply to your use of the platform.
7. Termination
You may stop using the service at any time. We may suspend or terminate your access if you violate these Terms or the Software Access Agreement, or as otherwise permitted by that agreement. Certain provisions, including intellectual property, disclaimers, and limitation of liability, survive termination.
8. SMS Program / Mobile Messaging

BDD Dustoff Client Communications
Program Description
By providing your mobile phone number to BDD Dustoff and consenting to receive SMS messages, you agree to receive recurring transactional and informational text messages from us at the number you provided. Messages may include:
- account and onboarding updates;
- records-review status notifications;
- appointment and deadline reminders; and
- important changes to your account or our service.
Message Frequency
You will receive approximately 2–4 messages per month, depending on your activity.
Message and Data Rates
Message and data rates may apply. Standard messaging rates from your mobile carrier apply to all messages sent and received. BDD Dustoff is not responsible for any carrier-imposed fees.
Opt-Out
You can cancel the SMS program at any time by replying STOP to any message we send. After you reply STOP, we will send a single confirmation message and then no further messages, unless you re-subscribe.

Supported Carriers
The program is compatible with AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, Cricket Wireless, and most other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
Eligibility
SMS service is available only to mobile phone numbers in the United States. You must be the account holder or have authorization from the account holder of the mobile phone you enroll, and you must be 18 or older.
Privacy
Your phone number is used solely to deliver SMS messages related to your account and our service. We do not sell, rent, or share your mobile phone number with third parties for their marketing purposes. See our Privacy Policy for full details.
Changes to the Program
We reserve the right to change or discontinue the SMS program at any time without notice.

10. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and, where appropriate, notify you by email.
11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.
